Advantages as an EU citizen

As an EU citizen, you have the right to buy property and reside in Spain without a visa. The process is simpler than for non-EU citizens.

  • No visa required to reside in Spain.
  • You can apply for the EU Citizen Registration Certificate (green card) if you plan to stay longer than 3 months.
  • Access to mortgages on the same terms as residents (up to 80% of appraised value).

Tax considerations between Spain and Germany

Spain and Germany have a double taxation agreement (DBA), which prevents you from being taxed twice on the same income:

  • Rental income from Spanish property is taxed in Spain (IRNR at 19% for EU residents).
  • In Germany, you must declare this income, but the exemption with progression method applies.
  • Capital gains on sale are taxed in Spain and reported in Germany with a credit for tax paid.
