Tax considerations between Spain and Germany
Spain and Germany have a double taxation agreement (DBA), which prevents you from being taxed twice on the same income:
- Rental income from Spanish property is taxed in Spain (IRNR at 19% for EU residents).
- In Germany, you must declare this income, but the exemption with progression method applies.
- Capital gains on sale are taxed in Spain and reported in Germany with a credit for tax paid.
